Kaspersky Internet Security 2010 may be your issue. someone had reported an issue with this version a few days ago, but i don't remember right now the post. but probably you will be required to add apup into the trusted apps rule in order to get rid of those errors

I have xcopy. I just downloaded a fresh copy of apup, put it in an empty folder, ran it and got the same errors.
I am running XP Home SP3, standard windows xp firewall and Kaspersky Anti-Virus 2010 v9.0.0.463.
In Kaspersky, I added apup as a trusted application, including all file access, network access, application activity and child application activity, but still get the same errors.
As we have potentially unsafe computers on the network, I can't afford to turn off Kaspersky to see if it's causing the issue, but every other program I've ever had problems with (because of Kaspersky) have worked properly after adding them as a Trusted Application.
I hope this helps narrow the issue down.

my friend, the issues related to Kaspersky Anti-Virus 2010 are already tracked. all those issues are caused by KAS 2010 and add apup to trusted zone doesn't help a bit. in 2010 version, KAS have added an kind of sandbox, where all apps run. but this doesn't work for apup and it will returns to you a dozen of errors and will not adapt your local version to an new one. we are trying solve this issue with KAS since over a month and, so far, nothing. please, take a look in the mail that i've sent to them:

only one problem: they didn't checked and the copy and paste text that they have sent doesn't solve the issue that their software creates. given this answer, i've opened another one, with KAS Brazil, hopping that speaking the same language, my lacks of translation could be avoided. big waste of time, they said that kas 2010 isn't being sell yet. they even don't bother to look into their own sales page. i was trying find an rule to fix this issue with kas, but my hd died. i'm now applying the updates and adding my security measures into the new one. then, i will try do another test with as and the 2010 version will stay in one of my machines for 2 weeks. that is even more than i can handle for an badly tested like the 2010 version, but i will try anyway. but in advance: it seems waste of time.
if you wish, please try open an case with kas about this. but they will say that this is our problem and isn't. if you wish, you can try the same with 2009 version and apup will work. even worst: this issue is created only with kas 2010. with any other security software, apup works

For example, CEC_Main.exe is part of many digital camera programs and is a safe file. However, the file is not a signed application, so by default we restrict it from critical system areas. Kaspersky's settings need to be changed so the program is Trusted. To set it to Trusted:
o Open Kaspersky.
o Click on Settings.
o Click on System Security.
o Click on the first Settings... on the right.
o Look for CEC_Main.exe (or your program's name) in the lists and click on it.
o Click Move to and select Trusted.
o Click OK twice to close all the windows.
If you need to exclude a file or folder from being scanned:
Your Kaspersky program can be set to exclude a specific file, folder, or even an entire drive from being scanned.

o Open Kaspersky.

o Click System Security on the left.
o Click Settings on the right of Enable Firewall.
o In the Rules window, click the Network tab. You will usually see two connections here, one for the Internet, the other with the brand of network adapter you have (Intel, 3Com, etc). The Internet one should already be set to Public network, and the other set to Local. Right click on Local and select Trusted Network.
If you're having trouble using a Wireless Internet Service Provider:
Kaspersky 2009's Anti-Dialer will block hidden dial attempts. In some cases, this will block your Aircard (or similar cell connections) unless the number dialed is added to the Anti-Dialer Trusted numbers list.
o Open Kaspersky.
o Click on Settings.

I'll contact Kaspersky and see if I can get them to resolve it, but I don't hold much hope...here's why:
A friend who owns a computer store submitted info to them about a new virus including instructions on how to clean it. Kaspersky then started detecting the virus, but didn't clean it properly. My friend told them and they responded that protection for the virus was added on <date>, please update your virus definitions and run the scan again. My friend said: I know, I'm the one who told you about it!!! And you didn't implement the clean method I told you about properly!!!
It was so difficult for him, he didn't bother trying to help them out again.
Anyway, a couple of quick questions, so I can be specific when talking to them:
- What version of VB are you using?
- Are the functions that are failing run from within a VB application? or a VB script? or a batch file?
I'm a Delphi programmer and I might be able to write a helper application that executes the commands in a way that Kaspersky will not block.

i didn't tested properly, because my hd has died. but the issues seems to be related to the .bat files that apup need to adapt the release. i just didn't tracked if the issue is solved when you remove the preactions. but that can be easily tested reaching the releases.list file, downloading any script to an specific folder, editing it to remove all the preactions and running apup like this:
apup.exe /log /localscript:D:\xp enu\autopatcher_java_x86.script

just an head's up: kas IS 2010 is already in place and updated. apup was made trusted and, as expected, it didn't worked. i've tried scripts with old style preactions and that didn't worked. same errors. with the direct approach (like del, rmdir and xcopy) didn't worked as well. trying an script without any preaction, apup works. so, surely the issue is related to that part of apup
